Red Diesel Rules for Construction Plant in 2026
Since April 2022, the rules on red diesel (rebated gas oil) changed significantly for construction and many other sectors. If you run plant, here is what you need to know in 2026.
What changed
Most construction, plant hire and industrial users can no longer use red diesel and must run on standard white diesel (DERV). The concession was removed for the construction sector, so mini diggers, dumpers and loaders used on commercial sites should be running on white diesel.
Who can still use red diesel?
A limited set of sectors retained entitlement — notably agriculture, horticulture and forestry. If you use a machine purely for qualifying agricultural work, red diesel may still be permitted. The rules are specific, so check HMRC guidance for your exact use.
Practical points for owners
- Don’t leave old red diesel in a tank used for commercial construction work.
- Keep fuel receipts as evidence of compliance.
- If you switch a machine between agricultural and construction use, understand the fuel rules for each.
